D. David Morán Bovío, catedrático de Derecho Mercantil de la Universidad de Cádiz y representante del estado español  en UNCITRAL desde 1989 destaca, en la obra “World Arbitrarion & Mediation Review”, 2012, volumen 6.1º, en la 37ª sesión, la participación de la Unión Internacional de Abogados –representada por el Socio Director del Despacho junto con Don Angel Ballesteros- pero sobre todo, la aportación realizada para el desarrollo posterior de los trabajos. 

Así consta:

At the 37th Working Group Session the Union Internationale des Avocats (UIA) presented a proposal to draft an international convention on cross-border insolvency.83 The proposal was composed of two parts: the first part seeks to ensure three issues: access to courts for foreign insolvency representatives, (b) recognition of foreign insolvency proceedings, and (c) cooperation and communication between insolvency representatives and courts. Under the proposal, if consent is reached on the first part, the second part will address the cross-border competence of the insolvency judge and the determination of the applicable law.

The UIA’s proposal would therefore amplify and reinforce the harmonizing effects of the Model Law on cross-border insolvency proceedings.

Despite the clear difficulties of gaining international consensus on so many difficult matters, the proposal immediately received strong support, which was driven more by the potential benefits of the proposed convention than by its feasibility.

The Working Group will reflect more deeply on the UIA’s proposal in its next Session some which are related to the UIA proposal.

Importantly, however, the discussion has been enriched by the participation of delegates and observers who were previously absent, including from countries such as Egypt, Uganda, and the Democratic Republic of the Congo, as well as from international organizations such as UIA, to name but some of the most active participants in recent Sessions who have made very valuable contributions.
