The new regulations on data protection have also reached the communities of owners, who must review their video surveillance or the treatment of the data of the owners, among other matters.
Living in a community of owners implies a safe treatment of the data by those responsible - the community itself - and those responsible for such treatment - farm managers. In particular, there must be a secure maintenance or an "armored" protection of the data of the owners.
In addition, placing a video surveillance camera in a private garage requires a mandatory contract. Likewise, disseminating on a dashboard information related to energy consumption may imply a sanction, while it is not possible to assign the mail addresses of a board member to third parties.
Spanish courts have shed light on these legal obligations with several examples of the legal reality on some practical problems in the management of communities and the relevant application of the new data protection regulation (RGPD).
